Is ringless voicemail legal for insurance leads?

Short answer

Only with the right consent. In 2022 the FCC ruled that ringless voicemails are calls under the TCPA, so a marketing drop needs the same prior express written consent as a prerecorded call. The message must name your business and give a way to opt out.

Michigan goes further and bars recorded message sales calls, so skip voicemail drops there.

The FTC has also said consent for prerecorded calls cannot be bought and sold with a lead. That came from an FTC post, not a court, but it is a reason to be careful with drops on bought leads.

A live voicemail you leave by hand is not a ringless drop and is treated like a normal call. This is a summary, not legal advice.
