Is the FCC one to one consent rule still in effect in 2026?

Short answer

No. The Eleventh Circuit threw out the one to one consent rule in January 2025, days before it was set to start, and the FCC formally removed it in 2025. The older written consent rule still applies to autodialed and prerecorded sales calls.

The rule would have made every consent form name one seller at a time. In Insurance Marketing Coalition v. FCC, the court said the FCC went past what the TCPA allows, and it also struck the rule that calls be "logically and topically associated" with the form.

What is left is the prior express written consent definition in 47 CFR 64.1200. It needs a signed writing, which can be electronic, that shows the seller and the phone number, and says buying is not a condition of signing.

In February 2026 the Fifth Circuit went further in Bradford v. Sovereign Pest Control and said written consent is not needed for prerecorded marketing calls in that circuit. Other circuits have not followed yet, so keep collecting written consent. This is a summary, not legal advice.
